English summary: The articles in this volume document the results of a conference of experts on the law pertaining to foundations on issues regarding the limits of permissible forms and purposes of foundations and the reform of the private law pertaining to foundations. The previously expressed criticism of the organization of foundations by the state and private persons, which only dealt with certain points, is repeated here in a concentrated form. The authors of the articles study basic questions surrounding the discussion on foundation policies and law in Germany. German description: Die Beitrage in diesem Band dokumentieren die Ergebnisse einer Tagung von Experten des Stiftungsrechts zu Fragen der Grenzen zulassiger Stiftungsformen und Stiftungszwecke sowie der Reform des Stiftungsprivatrechts. Die bisher nur punktuell geausserte Kritik an der Praxis der Ausgestaltung von Stiftungen durch Staat und Private wird hier gebundelt wiedergegeben. Die Autoren der Beitrage beleuchten Grundfragen der stiftungspolitischen und stiftungsrechtlichen Diskussion in Deutschland. Dabei zeigt sich, dass von einer uberschiessenden Instrumentalisierung gesprochen werden kann, wenn vom Leitbild der gemeinwohlkonformen Allzweckstiftung abgewichen wird.
